It's possible to apply for a divorce in Australia after being separated for a period of no less than one year. An application asking for divorce can be made by a single party or both parties cooperatively. In some situations, a divorce can be given to a couple that still live together, even after separation, so long as they prove to the court that they are not staying as a married couple.
The duty of the Child Support Agency is to evaluate the support obligations of your child after you have placed an application requiring an assessment to be done by the agency. The amount of child support payments to be paid depends on the income of parents, the number of children being considered and also the living arrangements the parents have.
In many situations, there is an unfair financial imbalance between the two parties as a result of separation. The family court will order spousal or partner maintenance if one party can prove to the court that they are not able to cater for their own basic reasonable needs which usually include housing, car and up keep money, as a result of the separation or divorce.
The Stage at which a relationship changes to become a de facto relationship can be hard to identify. Our lawyers are able to give you very important advice about the factors that the Family Court will consider when making a judgment as to whether there exists a relationship which is de facto or not.

Daniel was exceptional. Was very quick at getting things done and sorted, responds almost instantly and was very nice and easy to speak to. Didnāt make it seem so daunting.
