Conveyancing is the legal process of transferring legal ownership of a property from one party to another. Selling or purchasing property is one of the most significant financial transactions you will make. Due to the financial and legal aspects of transferring property, the process can be costly, stressful and time-consuming.
You will either purchase from the seller directly or deal through a real estate agent who represents the vendor or seller. In either case once the price has been agreed you will need to sign a written contract. If you buy privately the seller's lawyerwill usually prepare the contract, otherwise it will usually be prepared by the real estate agent.
If you are selling your property you will either engage a real estate agent to market and negotiate the sale on your behalf or you will deal directly with the buyer. There is no requirement that you use a real estate agent. You may advertise your property yourself. Many people prefer to employ an agent to avoid having to negotiate directly with a prospective buyer.
Are you purchasing an established property? Sproal & Associates recommend you request that a building inspection clause be inserted in your Contract prior to signing. If you have not already organised an inspection report we recommend you contact one of the inspection companies below that have proven reliable for other clients.
