We don't just see divorce as a process of bringing a marriage to an end - it is also the beginning of a new journey for both parties. In our experience, the path to obtaining a divorce order can sometimes be a complex one, both financially and emotionally. Whilst obtaining a divorce order is a separate matter to resolving property settlement and parenting related matters, it can have an important impact on both.
Divorce, property settlement, and parenting disputes are different issues that are often handled separately. The emotions surrounding the division of property arising from separation can be as strong as those involving children. The division of property between separated parties is subject to the overriding principle of what is "just and equitable" in the circumstances.
When separating, it is important to consider how your separated living arrangements will impact your children, including where the children live and/or how they spend time with each parent. It may not be safe for your children to spend time with their other parent until certain risk factors are addressed, including but not limited to avoiding their exposure to family violence.
The legislation that determines property and parenting related matters for de facto relationships in Western Australia is the Family Court Act 1997. De facto matters include both heterosexual and same-sex relationships. If you fall within the requirements that define a de facto relationship as stated below, then it may be necessary for you to consider the necessity to address property settlement related matters.
