Recent cases in the Federal Circuit and Family Court of Australia have again emphasised the importance of formalising a division of property as soon as possible after a marriage has ended. Once a relationship has irretrievably broken down, it is in the parties' best interests to resolve their property settlement sooner rather than later.
In the making of any Parenting Orders, including Orders which prescribe who a child lives with, who a child spends time with, communicates with, the Court must regard the best interests of the child as the paramount consideration. The overriding factors set out in the Family Law Act which demonstrate the purpose of the legislation as to arrangements for children upon separation of their parents are as follows:.
Parties separate when at least one of the spouses forms the intention to end the relationship and then acts upon it, usually when one party moves out of the matrimonial home. However, it is possible to be separated whilst both parties reside in the same accommodation. In some circumstances, Courts will recognise a couple as having separated even though they are still living in the same household.

I felt my situation being overseas made for things to be a little more complex and tricky. The conveyancing team were amazing. They were responsive (working around timezone issues), able to find alternatives, provide solid advice and very friendly. When Amanda went on holidays she made sure everything was covered by another and introduced the person to me. Little things like that made me feel confident things would not get dropped.

We recently sold a property in the Toowoomba region and Briese did our conveyancing. Amanda was a voice of assurance to us from the very start and get things smooth right to the end. In fact every Briese team member we spoke with was courteous, professional and helpful.
Our sale was a painful job for them as we had property issues with council that we had to overcome, causing a delay in settlement.
