To apply for divorce in Australia, you need to have been separated for at least one year. However, you do not need to provide a reason for getting divorced other than that your marriage has broken down irretrievably. If you and your partner have not been living separate and apart for a continuous period of 12 months, you will be required to file additional documents in court to provide evidence that you are separated.
You do not have to be divorced to split property between you. Divorce is a completely separate process to the finalisation of property and finances between parties. It is important to obtain legal advice of your rights and obligations as soon as you separate or if you are considering separation. And it is advisable to begin negotiating the details of how your assets will be divided as soon as possible after separation.
Agreeing about the care of children after separation is usually the best outcome for both you and the children. Children can react differently to separation depending on their age and their individual temperament. Conflict between parents can increase the stress for children and it is important that they are supported and encouraged to have a meaningful relationship with the other parent, provided it is safe to do.
