An application for a divorce, or a dissolution of marriage, will usually be made to the Federal Circuit Court of Australia. Before you can apply for a divorce, you will have to be able to demonstrate to the court that your marriage has broken down irretrievably. To do this it is necessary to show that you have been separated for a period of at least 12 months.
When parties to a marriage or a de facto relationship separate, they will need to try and reach agreement on a property settlement that allows for the distribution of property from their relationship and otherwise bring financial matters between them to an end.

Where parties have been able to reach agreement on the distribution of property from their marriage or de facto relationship, they have the option of formalising that agreement by recording it in a Binding Financial Agreement or BFA. A BFA is, in essence, a contract between the parties which sets out the terms of their agreement.
