Mitchells Solicitors is a leading law firm with offices in Brisbane City, Moorooka, Aspley, and Sunshine Coast. The firm enjoys a long legal history. In 2006, the firm merged with the law firm Wyman & Co Solicitors, which commenced trading over 50 years ago. More recently, the firm merged with the practice of O'Dwyer & Bradley, the Principal of which is Mr Tim O'Dwyer and who remains a consultant at this firm.
We can offer specialist advice if there is a dispute over the Will, if someone has been left out of a Will, if you think there has been undue influence on a Will maker, if you think the Will maker had lost capacity at the time of writing the Will, or if the Will doesn't make sense. We can assist you to write or amend your Will, establish trusts, and give structuring advice to make sure you have peace of mind.
In each of the states of Australia the law casts an obligation upon a Will maker to make adequate provision for certain persons. It is at the discretion of the court as to whether or not an eligible applicant will be further provided for under the Will. Not every applicant will be successful. The key is to seek advice from an expert in succession law.
Executors have certain responsibilities and obligations to administer the estate faithfully. There may be a perception that the executor is not doing the right thing with regard to the administration of the estate. Sometimes the reality is that the executor is not administering the estate in the way the executor ought.
Superannuation proceeds are not part of an estate of a deceased person unless the Trustee of the superannuation fund actually pays the proceeds into the estate of the deceased person. Upon the death of a member of a superannuation fund the primary position is that the Trustee of the fund has an absolute discretion in paying the superannuation proceeds to one or more persons who are defined under superannuation law as "dependents".

Absolutely useless. You would be better off representing yourself and saving yourself thousands. They have absolutely zero customer service and profit ($$$) comes before anything (ANYTHING) else. The lawyer that represented us was not very knowledgeable. Extremely disappointed with this company and the lawyer that was supposedly representing us. GO ELSEWHERE!

I wonder how humans, let alone "professionals" can knowingly use fake DV allegations to gain advantage in property and child custody cases. Where are the rights of the children.
