Separating from a spouse or de facto partner brings with it many issues to consider and deal with. If you have separated, or separation seems likely, our experienced Noosa family law solicitor can provide you with useful legal advice that will help you understand your legal position and stand you in good stead as you embark upon the process of finalising legal matters through some form of family dispute resolution.
Divorce is a relatively straightforward process for most, particularly when both spouses are aware of the other's whereabouts. In Australia, we have a no fault divorce system, so neither spouse is required to prove that the other spouse is to blame for the marriage breakdown.
An application to the court can be made jointly (if both parties are willing) or separately, in which case the application must be served on the other spouse so they are aware of the proceedings and can participate if they wish to.If you and your spouse need to divide your assets, i.e. attend to a matrimonial property settlement, you do not have to wait until you are divorced before you do this.

One unfortunate consequence of the breakdown of some adult relationships is the disruption to, and rearrangement of, children's lives. Parental separation is traumatic in itself - causing anguish and emotional damage to young and adolescent children. That trauma is magnified when routines are broken, and where vulnerable children are exposed to hostile parental conflict and disagreements about parenting arrangements.
Financial Agreements (commonly called Binding Financial Agreements) are legal contracts made under the Family Law Act 1975 to deal with financial matters between the individuals who sign them. A Financial Agreement can be entered into before or during a marriage, or after divorce, as well as before or during a de facto relationship (including same sex relationships), or after a de facto relationship has broken down.
