Separation unfortunately means that life for the whole family changes - including your children. Arrangements for children include how much time the children will spend with each parent and who will be responsible for long term decision making. Many couples are able to reach an amicable arrangement regarding children's arrangements.
Roberts Lawyers Family Law Experts can assist you in filing your divorce application in the Family Court of Australia or in the Federal Magistrates Court and make certain that you obtain your divorce smoothly, efficiently and as quickly as possible. To obtain a divorce you need to show that you and your partner have been separated for a continuous period of more than 12 months (or 1 year) and there is no reasonable likelihood of reconciliation.
Financial Agreements can apply to both de facto relationships and marriages, and can be completed before, during or after the marriage or de facto relationship. Financial Agreements are commonly used post separation as a means to reaching a property settlement. There are two options to formalise a property settlement, a Financial Agreement and Consent Orders.
At the end of a relationship, it is necessary to determine how to divide up your assets and financial resources. A property settlement is the term used to describe who gets what after the end of a marriage or de facto relationship. The Family Law Act 1975 covers matters relating to property settlements for married couples and de-facto couples.
