Separation can be a stressful time and legal costs can be uncertain. In order to minimise any unnecessary stress on you and your family during your separation, our aim is to provide you with certainty on your legal costs. The last thing that you need to be worried about whilst going through a family law settlement is how much it is going to cost and how you are going to pay.
You do not need to be divorced to apply for a property settlement. A property settlement can be applied for at any time after separation, even if you are still residing in the same property. There are common myths regarding percentage splits, particularly that "the wife gets everything", or that is is 50/50.
You need to be separated from your spouse for 12 months before you can apply for a divorce. You need to satisfy the Court that you and your spouse have lived separately and apart for at least 12 months, and there is no reasonable likelihood of resuming married life. It is possible to live together in the same home and still be separated.
Many parties settle their matters without the need to go to Court or get lawyers involved in negotiations. If you have reached agreement with your ex spouse and you want to formalise that agreement and make it binding, you can apply to the Court for Consent Orders. Consent orders have the same legal effect as an order made after a Court hearing.
