Actuate IP's fixed fee proposal along with "unlimited access" is a farce. They will bill you for services you didn't agree to as if you've written a blank cheque and are not in contact when you ask. More importantly, the legal advice I received employed the strategy of prolonging contention and drawing out the process (to prolong the use of their services). I ended up settling this matter myself directly and paying far too much for inconclusive information that didn't resolve the matter. The learning is this - whoever has the greater funds is legally correct.

I've had a very good experience dealing with Jennifer Driver at Actuate IP. Firstly the fees are detailed up front so you know what to expect at every stage of the trade mark process with no hidden and extra charges. We were given good advice on how to initially TM our brand name / logo so as to get a better chance of a success TM.
