We have recently seen an uptick in the incorrect use of Attorney powers in a Financial Enduring Power of Attorney. A common mistake is that the Attorney believes they can use the Financial Attorney powers to make decisions on behalf of the principal, in their role as a director of a company. When deciding the type of ownership to register your property, the most common choices are Tenants in Common or Joint Tenancy.

A Will is a document that sets out your legally binding directions on how to divide your personal assets on your death. Your personal assets are known as your estate. Your Will can only give away what you own in your sole name. A Will cannot give away assets that are owned jointly with another person.
The role of your medical treatment decision maker("MTDM") is to make medical treatment decisions on your behalf if you do not have the capacity to do so. Whilst you have capacity to make your own decisions, your appointed MDTM has no role or status. A decision by your MDTM has the same effect as if you had capacity and had made the decision yourself.
