Established in 2010 by Principal Craig Scott, CMS Legal is a trusted family law firm based in Perth, WA. Specialising in separation, divorce, child custody and division of assets, we're here to guide you through to life's next chapter - whatever it may be. Craig graduated with a Bachelor of Laws from the University of Western Australia. Working at a number of city law firms, Craig practised Family Law, Commercial Law and Estate Planning matters. Since then, he has commenced his own boutique legal practice specialising in Family Law, CMS Legal, with the aim to spend more one-on-one time with his clients.
When life throws a curveball and family life doesn't work out quite the way you planned, it can feel like you've had the rug pulled out from under you. Emotions run high, stress levels skyrocket - yet somehow you have to collect yourself and make big decisions. At least you know the caring team at CMS Legal is here to help.
Both you and your partner have the right to remain in the family home. Neither of you can force the other to leave, so your best option is to simply sit down for a chat to see if you can come to an arrangement as to who stays and who goes. Separation is when you and your partner stop living together as a couple.
Yes, that's possible. They can file a Response to Divorce if they disagree with any of the information provided on the application or if they oppose the divorce (however, there would be limited grounds for the Court not to grant the divorce). Not if you do not have children under 18 or you marked the box on the application for divorce stating you do not want to go to Court, and your partner does not object to your application.

Lack of communication or any sort of help from these useless unprofessional so called lawyers who just hand balled my partner from one unprofessional to another!! A email was sent to them notifying them that we no longer required their services and of course no response apart from the final $300 bill!! CMS Legal was the biggest waste of hard earned money!! 1 star is even too much for them!!

Very unprofessional service, lack of communication, does not return phone calls. Now applying to the Law Society for a refund of the money they demanded upfront for service they did not carry out. They said they would return money and asked for my bank details but would not take my phone calls after not receiving it. Very unhappy and would never recommend to anyone. Sad to have to say this as I don’t like to put any business down but feel the need to warn others on the service I received ☹️

I Have been represented by CMS for the last two years through a very complicated case between my ex partner and divorce proceedings. They have met my expectation and delivered on what I have asked. When going through the courts system it is important to note that submission of documents can equate to $1000's of dollars before any lawyer touches them so be prepared and don't expect a bargain when it comes to the court system. Its not a dollar dazzler sale and the prices are the same for everyone.
My matter has been costly but not over the top and given the nature of my case it should have been

CMS Legal Family Lawyers failed to meet my expectations.
First time I have dealt with lawyers and now the harsh jokes about lawyers really make sense.
They are more interested in money than anything else. I really thought they would be experts in family court matters but that view was quickly diminished. I would be more than happy to pay top money but I believe their service was not worth it.
There is a possibility the lawyer I was assigned is the reason my expectations were not met, but please choose carefully, just because they are at the top of google search and have 5 stars doesn't mean

I lost total contact with my kids and had this company representing me. They were adamant I would have some sort of shared custody. I employed their services in 2011 to obtain official 50/50 custody of my 3 children only to come away with absolutely no custody and no contact whatsoever with my children and nothing has changed 2 years on. CMS didn't even fill out my Initiating Application to the courts correctly requesting the court for an Interim order to be made for me to have some sort of contact with my kids...BIG MISTAKE. My ex-husband was a liar, falsified affidavits to the court which I could
