If you and your partner have decided to go your separate ways, or if you are unsure about your entitlements should the relationship break down, it is prudent to have a discussion with a family lawyer about your rights and obligations in the event of a separation. Divorce Applications

If you have been separated from your partner for 12 months, you are eligible to apply for a divorce, as is your partner. The Family Court of Australia publishes a helpful Divorce Kit online. Many people choose to conduct their own divorce by following the guidelines set out in the Divorce Kit. Other people choose to have a lawyer handle their divorce, as it is an efficient way to complete filing and service of all requisite documents.

Parties in a domestic relationship, whether that relationship is marriage, de facto marriage or a same sex relationship, usually accumulate a property pool over the duration of the relationship. Upon separation, many couples are able to agree as to the division of assets and liabilities. In the event of a dispute between the parties as to the splitting up of various assets and liabilities, it is prudent to consult with a family lawyer.
