A Trade Mark is a brand name, a representation or "sign" used to distinguish the Goods or Services. A Trade Mark may take the form of a word, logo, colour, shape, scent or sound and is filed in one or more of 45 Classes.
A Design relates to the appearance of an article/product and is directed to the features of shape, configuration, pattern or ornamentation as applied to the article. In order to be suitable for registration, the Design must be new and distinctive. A Registered Design gives you the exclusive rights to commercially use, license or sell products bearing the Design.
